Kino Cove Terms of Service

These Terms of Service ("Terms") govern your use of the Kino Cove app and website (the "app"), provided by Kino Cove LLC ("Kino Cove," "we," "us").

1. Agreement to these terms

By creating an account or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Who can use the app

You must be at least 13 years old to use the app. If you are under 18, or under the age of majority where you live, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your use of the app. The app is not directed to children under 13.

3. What Kino Cove is, and is not

Kino Cove helps you organize household preparedness information and plan ahead. It offers general educational guidance and surfaces public hazard, weather, and disaster data from third parties. It is not a substitute for professional, medical, legal, or emergency advice, and it is not an emergency-response or alerting service. In an emergency, call 911 or your local emergency number and follow instructions from official authorities. Do not rely on the app as your only source of warnings or safety information. Hazard, weather, and air-quality information comes from third-party public sources and may be delayed, incomplete, or inaccurate; we do not guarantee it.

4. Your account

You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate information and keep it current. Tell us at info@kinocove.com if you suspect unauthorized use.

5. Your content

You keep ownership of the household information, documents, and media you add ("Your Content"). You grant Kino Cove a limited license to store, process, and display Your Content solely to operate the app for you, such as backing up and syncing your data and showing it to the people you choose to share it with, including the members of your household. You are responsible for Your Content and for having the right to add it. Valuables Vault files are stored on your device and in your household's private storage, where members of your household can access them, as described in the Privacy Policy.

6. Acceptable use

Do not misuse the app. You may not use it unlawfully, attempt to breach security or access another user's data, interfere with the service, reverse-engineer it except as permitted by law, or upload content that is illegal or infringes others' rights.

7. Plans and payments

The app currently offers free access during the beta. Paid plans may be introduced later. If they are, any purchase made through the Apple App Store is handled under Apple's terms, and we will disclose pricing and billing details before you are charged. Tier names and prices shown in the app before paid plans launch are informational only.

8. Third-party services

The app relies on third-party providers and public data services listed in the Privacy Policy and the in-app Data Sources screen. Those services are governed by their own terms, and we are not responsible for them.

9. Changes to the app

We may add, change, or remove features, and we may suspend or discontinue the app or parts of it. We will give reasonable notice of material changes where we can.

10. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that any information it provides is accurate or current.

11. Limitation of liability

To the fullest extent permitted by law, Kino Cove LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the app, including any reliance on information it provides. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50.

12. Indemnification

You agree to indemnify and hold harmless Kino Cove LLC from claims arising out of your misuse of the app or violation of these Terms, to the extent permitted by law.

13. Termination

You may stop using the app and delete your account at any time, under Settings → Account → Delete account. We may suspend or end your access if you violate these Terms or to protect the service or other users.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Courts located in California will have jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.

15. Changes to these terms

We may update these Terms as the app changes and will revise the date above. Material changes will be communicated in the app. Continuing to use the app after changes take effect means you accept the updated Terms.
